Organized Crimes Must be Nipped At The Bud....

MCA NGO Bureau would like to congratulate Starprobe in their expose on the beggars syndicate using "foreign" disfigured beggars at several night markets in Malacca.

The organized activities of these syndicates will tarnish, damage and eventually destroy our nation's image and reputation. The activities of these syndicates must be expelled and eradicated from our Malaysian public life as it is a poor reflection of our nation and government.

The Bureau is concerned with the methodology of these syndicates in using disfigured and defaced beggars who were beyond recognition. The fact that their fingers were maimed and removed seems to point to an effort to remove any form of identification.

What is there to guarantee that these beggars may not be foreigners or may have been abducted locally, defaced and maimed inhumanly and forced to be beggars and slaves to the syndicates for the rest of their life?

What if the syndicates resort to abducting locals instead of foreigners if the going is good and the return lucrative whereby it is more convenient and cheaper to abduct local victims using the same modus operandi?

The ugliness and the inhuman approach by these syndicates ought not to be tolerated. The Malaysian public must show their utter abhorrence's and contempt of this ugly and hideous crime.

The authorities must show their pro-activeness and seriousness by taking immediate and drastic actions to stamp out these activities before it is further rooted in our society.

In line with the Prime Minister's 6 NKRAs whereby reducing crime is primary on the list, the Bureau called upon the Police to take immediate actions to put a stop to the activities of these organised criminals.

The Police must not only be only hot on the heels of the taxi operators used to ferry the beggars but they ought to have made arrest and persecute the king pins behind these syndicates. There must be zero tolerance of these crimes.

We have seen how the authorities have lost in the war against Ah Longs, drugs and prostitution and similar syndicates as a result of our tolerances, attitude and inaction.

We do not want to see the activities of these syndicated beggars becoming a part of our daily sight and an ugly lifestyle that we have to live with .

We do not want to see the syndicates growing in force and influence such that we have lost our war against these organized syndicated crimes.

The Bureau noted with deep regret that organized crimes are fast growing and becoming a serious threat to our Malaysian peace, security and way of life. Of late many syndicated activities had rear its ugly head and surfaced into our public eyes. These activities foreign to our life had since been tolerated and accepted as our norms.

Reshuffle of Presidential Council is administrative matter

With reference to the recent reshuffle of the MCA Presidential Council as announced by the MCA President Dato’ Sri Ong Tee Keat after chairing the Central Committee (CC) meeting yesterday, 18 Nov 09, the media has been misled into making headlines that appear as if the Greater Unity Plan (GUP) had failed or there was abuses.

Words uttered to the effect of “chop, slash and burn” are a distortion of reality.
The dramatics of breaking down in public is a political drama. I can testify in public that the personalities who cried in public were happily laughing away during the CC meeting. It therefore, caught me by surprise that MCA leaders wept tears in front of the cameras yesterday.

On the new appointments to the Presidential Council, the Wanita MCA and Youth wings’ respective chiefs who were present at the CC meeting yesterday have every right to seek clarification. There was no need to go to the media and put on dramatics accusing the MCA leadership of wrongdoing whenever administrative actions were taken to implement CC decisions.

The Presidential Council is merely a body responsible for the administration of the affairs party. It is not an all powerful body, but being an implementing body, the MCA President needs to appoint people he deems fit and willing to support and implement the GUP as endorsed by the CC.

Article 46 of the Party Constitution reads:

“There shall be established from amongst the members of the Central
Committee a Presidential Council which shall consist of the President,
the Deputy President, one or more Vice Presidents, the
Secretary-General, the Treasurer General, the National Organising
Secretary, and not more than ten (10) other members appointed by the
President in his absolute discretion, who likewise may terminate such
appointment if and when he thinks fit.”

I wish to state that Datin Paduka Chew Mei Fun and Datuk Dr Wee Ka Siong are still the duly elected chairmen of the women’s and youth’s wings respectively. By virtue of Article 46 of the party Constitution, both leaders are also Vice Presidents.

The issue of “axing” does not arise as the President needs a team that will support and not continue a protracted dispute/debate CC decisions in the Presidential Council.

It is regrettable there has been posturing to mislead the public that the Wanita MCA and MCA Youth are not represented in the Presidential Council. Wanita MCA is represented by Senator Heng Seai Kie (Secretary-General) and Sdri Tan Cheng Liang (National Organising Secretary) which are very powerful positions. MCA Youth is represented by Dr Mah Hang Soon (Deputy Chairman).

We must emulate the instances where Umno Youth Chairman was not included in the cabinet reshuffle, but they maintain their discipline and did not cry foul or attempt to bring the party down. There was
absolute respect for the prerogative powers of the Chief. The line of command is clear and thus the order, discipline and stability.

In any organization, there is always an estimate of 30% dissent. This is a healthy culture in a democratic system. We cannot permit the vocal aggressive minority to disrupt the silent majority and bring down the structure, order or stability of the party. This political mob culture must be stopped. Dissent can be tolerated but not
continuous act of subversion. We must respect the party Constitution
and party order.

Vice President Dato’ Sri Liow Tiong Lai has repeatedly mentioned that CC decision must be respected. I appeal to Vice President Dato’ Sri Liow and his colleagues to similarly respect the CC decision rejecting the EGM of 28 Nov 09, and not revert to unconstitutional acts of inviting the public to subvert the GUP. Please be responsible and work towards forging the GUP. It is regrettable that there are leaders who continually project that the party is in a crisis where as the top
leadership is trying earnestly to work towards the GUP.

No need for outside interference

On another matter, while I appreciate Deputy Prime Minister Tan Sri Muhyiddin Yassin who speaking from Rome had had shown concern for MCA reportedly said that UMNO would have to interfere into MCA matters, I hope that there will not be a political godfather culture within the party where rebellious quarters undermine the party agenda purely because they have the comfort of the ears of their political godfather outside the party.

The perception of external intervention into internal party matters which is only administrative of nature will further damage the party’s dignity or independence. When other BN component parties have internal bickering, we don’t see their leaders crying to component parties to interfere.

There are people from within the party setting the platform for outside interference. This is only is peculiar only to MCA where personalities unashamedly are seen or perceived to be orchestrating a scenario to justify outside intervention.

I appeal to all to respect the party Constitution and the organization structure. External interference into our party matters will be perceived as undermining
MCA as a party, disrespecting our party Constitution besides belittling our leadership.

It is my hope that party members who hold close ties with BN leaders will not project a distorted situation to invite their interferences.

Once again, I appeal to all party leaders and grassroots members to close ranks, and pledge full support for the GUP. Please make the GUP work, and refrain from attending the 28 Nov 09 meeting which is unconstitutional and will continue to destabilize the party.

Why are Backbencher MPs behaving worst than...

The irresponsible manner in which Government Backbenchers took the
government ministries to task on non-issues is indeed a disappointment to the public.

It is worst if Members of Parliament from the Backbenchers are seen to be barking at the wrong tree or perceived to be abusing their parliamentary privileges to discredit targeted Ministries or Ministers.

MCA NGO Bureau called upon elected representatives to live up to the
KPI culture in their performance as Members of Parliament.

In the name of commitment, accountability,transparency and integrity Sri Gading, Dato’ Mohamad Aziz, ought to be taken to task for misleading the public with regard to the purchase of four used diesel multiple units (DMUs) by KTM Berhad.

He had barked at the wrong tree and should have done his
homework before smearing the Ministry of Transport by abusing his
parliamentary privileges and misleading the public into believing that
there are impropriety or abuses.

Of late, there are elected representatives from the government
backbenchers who are behaving worst than irresponsible opposition
members in distorting or misrepresenting to the public on alleged
abuses whereas there were existing blatant abuses and public misappropriations escaping their naked eyes.

Their actions had lead the public to believe that there was a dire need to upgrade the quality of our representatives who had failed to obtain further and better particulars from friendly parties or ministries but instead chose to blow a non-issue out of proportion thus causing increasing lack of public confidence on the government of the day.

This culture that used to be prevalent amongst opposition MPs is now prevalent among backbenchers raising the perception that our MPs lacked credibility, ability and integrity.

The questionable manner and sensationalism of a non-issue seems to
reflect on individual MPs but also reflects badly on the government
and Barisan Nasional as the ruling party.

One starts to wonder why are so many pressing and obvious issues or abuses such as the PKFZ scandal conveniently escape their eye? Why are they spinning a non-issue into an issue? Why are they picking only on a particular Minister and Ministry that has been acting in accordance with the public expectations of commitment, accountability and transparency?

These actions seem to be sending a wrong signal to the public. It is as if, the backbenchers are going for a head hunting spree.

Unfortunately the head that they are hunting seems to be those who are publicly perceived to be pursuing and walking the talk of public commitment, accountability and transparency.

Ti lauds report on MACC’s investigation

KUALA LUMPUR: An MCA central committee member has welcomed a report that the Malaysian Anti-Corruption Commission (MACC) has not found any evidence indicating Datuk Seri Ong Tee Keat has received RM10mil for party activities.

“We are glad with the speedy investigation by the commission,” said Datuk Ti Lian Ker in a statement.

The Star and Nanyang Siang Pau yesterday stated the commission had not found any evidence to indicate that Ong, the MCA president, had received RM10mil from Kuala Dimensi Sdn Bhd CEO Datuk Seri Tiong King Sing for party activities.

It was learnt that investigations by the commission have so far drawn a blank, and nothing had been uncovered to back Tiong’s allegation.

Tiong himself is being investigated by the police and the commission for fraud, including overcharging and unsubstantiated claims in the construction of the controversial RM4.6bil Port Klang Free Zone (PKFZ) project.

Ti, the MCA’s non-governmental organisation liaison bureau chief, said Ong’s management of the PKFZ fiasco should be lauded and given full support.

A War for the Public Mind

COMMENT Do you know them? The arrogant, the self-serving and the ones who are failing in their duty after being swept into office.

They are everywhere, like the new flu that has gone viral in the human ecosystem.

Such is the inescapable scenario in Malaysian politics. The few who are sincere about answering the call of public service labour in the looming shadows of the dastardly inept and corruptible.

Few players in politics can claim the high moral ground these days and we have come to expect the unexpected. The eternal optimist will be hard put to rationalise the assorted problems besetting the system that includes racist politics, endemic corruption and opaqueness in governance. Pray tell, what else is new?

The main Chinese component in Barisan Nasional is caught in a maelstrom - again. MCA is a party in disarray. A body that was set up to look after the Chinese interests is now a body that is struggling not to fall apart.

Ong Tee Keat surely didn’t bargain for a roller-coaster ride when he took over from the other Ong.

MCA needs the people

But events one year later have proven to be a thrill-a-minute within the MCA corridors and provide rich fodder for political gawkers, bloggers and what-have-yous.

Much has been said and written about the Chua Soi Lek factor and the Port Klang Free Zone scandal that has opened up a can of worms. The ruling coalition in which MCA is embedded is in no better shape, its energy sapped by last year’s defining general election and beaten black and blue in the series of by-elections that followed. It’s hoping to break its losing streak with a strong but questionable contender in Isa Samad at the Bagan Pinang battleground.

The waning Chinese support adds to the stream of woes in MCA-dom.

Like celebrities who rely on their fan-base to thrive, MCA needs strong public support to regain its pride and place in Barisan Nasional and the government. In other words, MCA needs the people; the people doesn’t need it because there is viable alternative representation today.

So to continue to account for its existence, it must find new ways to regain the trust of the disillusioned and to pitch a new deal to the younger crowd whose minds are not yet set in their ways.

Amid the upheaval, it would be wise to review the party’s core support base – the Chinese.

The Chinese are not a monolithic bloc that thinks the same way. For the longest time, MCA has relied on the Chinese-educated segment for support in its varied permutations. They are the group that holds fast to all that identifies the race: Chinese media, Chinese schools and the assorted Chinese clans and associations.

Win over English-speaking segment

The English-speaking segment, though small in numbers, are the younger and Western-educated professionals who have huge resources at their disposal and wield great influence. Their priorities cut across racial boundaries, encompassing human rights, civil liberty issues and democratic principles. Their votes remain largely with the Opposition.

Some analysts in fact say they were the game-changer in the last general election. MCA will have to craft a strategy that wins over the English-speaking segment while not alienating its traditional support network.

It’s not going to be easy and there will have to be compromises made.

Executed well, the day may come when the MCA evolves to become a party that draws its lifeblood not just from the Chinese but Malaysians of every creed and faith. By then, it will have no need for the “C” in its name.

Far-fetched? Maybe. But it’s the policies set today that will shape the aspirations for a truly multi-racial party of the future.

Meanwhile, the MCA has fires to put out, come Oct 10.

Child Traffickers : Malaysia is transit point

MALAYSIA has been in the spotlight not as a source country but rather as a transit point for child trafficking.

A recent assessment found such trafficking activities continued despite the best efforts of the governments concerned and aid agencies.

The study, "Child Trafficking in East and Southeast Asia: Reversing the Trend", showed that a new approach was needed to confront not only child trafficking, but also other related forms of abuse and exploitation.

There were many instances of child labour, sexual exploitation and child violence or neglect.

The study showed that much had been done in generating bilateral, multilateral and transnational cooperation besides legislative and policy reform.

It was found, however, that enforcement of laws was generally poor in the countries.

Unicef said the study concluded that what was required to address the situation was the development of national child protection systems within countries, similar to the creation of effective health systems.

‘MCA conflict won’t dent BN hopes in by-election’

KUALA LUMPUR: The conflict between the MCA president and his deputy is expected to come to a head at the party’s extraordinary general meeting (EGM) on Oct 10, but a senior official thinks it will not dent Barisan Nasional’s (BN) standing with some 1,500 Chinese in the Bagan Pinang by-election, whose votes may be crucial at the ballot the following day.

MCA central committee member Datuk Ti Lian Ker said the Chinese in Bagan Pinang were more concerned with bread-and-butter issues, Chinese educational matters and the prime minister’s general policies rather than with political polemics.

He said the Chinese in the primarily urban constituency would appreciate that the government had been more accommodative towards the economic well-being of non-Malay communities by lifting the 30% bumiputera equity. They are also happy that there are now bigger allocations to build vernacular schools.

“Datuk Seri Najib Razak has brought in a positive vibe since taking over the premiership. There have been no sensitive issues his administration had introduced,” Ti told The Edge Financial Daily on Sept 23.

According to him, the MCA Teluk Kemang division under which Bagan Pinang falls, has not shown any indication whether it would support president Datuk Seri Ong Tee Keat or suspended deputy president Datuk Seri Dr Chua Soi Lek, so the MCA conflict should be a non-issue during the by-election campaign.

“MCA has always campaigned with one voice in any election... The local Chinese leadership will be able to deliver,” said Ti, who is also MCA NGO liaison bureau chairman.

Expressing confidence that MCA has a strong base of voters in Bagan Pinang, he however felt that should there be media hype and sensationalisation over the MCA conflict leading to polling day, the Chinese voters could be disheartened and end up either not coming out to vote or voting in protest.

“If every day during the campaigning period the MCA conflict is front-paged, then the general mood of the Chinese voters would be different,” said Ti, a former three-term state assemblyman.

Last week, MCA announced it will convene an EGM on Oct 10 to solve a crisis plaguing the party following the sacking of Chua. However, the party central committee had over the weekend overturned the sacking, in favour of a four-year suspension.

The by-election for the Bagan Pinang state constituency is anticipated to be another fierce face-off between BN and Pakatan Rakyat (PR). Some political analysts opined that the battle would favour BN as it would be an uphill task for the opposition pact to overturn the 2,333-vote majority obtained last year by Umno’s Azman Mohammad Noor on a backdrop of PR showing signs of cracks in a couple of states under its control.

An analyst said BN’s choice of candidate would be critical to ensure whether it would win big in Bagan Pinang, adding that Najib’s strong approval ratings coupled with some goodies expected to be thrown in and support of the majority of the 4,000-odd postal voters would force PR to do plenty of catching up.

Bagan Pinang has 13,664 voters of whom 8,577 or 62.77% are Malays, 1,498 (10.96%) Chinese, 2,834 (20.74%) Indians and others 755 (5.54%). The figure includes 4,604 postal voters.

The opposition, however, is not impressed. “Nobody cares about MCA. Did you read the latest online news?” said Negri Sembilan opposition leader Anthony Loke when contacted.

He said the MCA conflict had virtually no bearing on the Bagan Pinang by-election and that PR would want to reach out to the voters en masse with a combination of national and local issues, including the Port Klang Free Zone scandal, death of political aide Teoh Beng Hock and the Perak political impasse, to ride on.

Loke pointed out that the by-election would be a platform to advise voters on the higher cost of living in Negri Sembilan, as the DAP had received numerous complaints that household water bills in the state have surged following the corporatisation of the Negri Sembilan Water Supply Department early this year.

“There has been no increase in water tariffs but many have complained that their water bills have gone up quite high,” said Loke, who is also Lobak assemblyman and Rasah MP.

“Every voter is a king-maker and it is our duty to bring to the attention of the voters any shortcomings in the governance and delivery system of the state,” he added when asked if the DAP would mainly concentrate on the Chinese voters.

Prior to the death of the Bagan Pinang assemblyman, BN controlled 21 of the 36 seats in the Negri Sembilan state legislative assembly, while PR has 15. The Election Commission has fixed Oct 3 for nomination and Oct 11 for polling in the event of a contest.

PETALING JAYA (Sept 23, 2009): The sex DVD featuring suspended MCA deputy president Datuk Seri Dr Chua Soi Lek has resurfaced just before the extraordinary general meeting (EGM) on Oct 10, bringing the party's internal conflict to another level.

An unknown "third force" is said to be redistributing the DVD to fuel the anger of Chua's supporters against party president Datuk Seri Ong Tee Keat.

The DVD is allegedly being distributed to the central delegates as well as some Barisan Nasional leaders.

In a statement today, MCA non-governmental organisation liaison bureau chief Datuk Ti Lian Ker said there is a "hidden hand" in the DVD issue that has damaged MCA as a credible political party.

"The DVD incident is an incident of the past and Chua has been an unfortunate victim of these unseen hands rendering him a liability to the party. The DVD is a blemish of the past and ought to be cast out and not continue to last," he said.

"MCA members must not be distracted with the re-emergence of the DVD by a third force calculated to instill maximum damage to the party and arousing the anger of Chua's sympathisers against Ong."

Ti said the central committee had recognised that Chua had discharged his duty well in the past and there was no necessity to embarrass him any further.

He said the party is faced with a leadership conflict as a result of the DVD incident. The re-emergence of the DVD is another move by unseen hands to incite emotions, anger and hatred among the members to embarrass Chua, calculated to put the blame on the present MCA leadership.

"There is indeed a third force from within the party intending to exploit and inflict maximum damage to the personality and credibility of both Ong and Chua with little or no love for the party," he said.

"Their apparent motive is obvious, to dislocate and uproot Ong's leadership of the party and to damage Chua permanently. The ultimate effect of an angry MCA will result in the party being shattered permanently and whoever leads the party subsequently will be a lame duck."

Ti said the third force wanted to control MCA's leadership for its personal motive and agenda.

He said the disagreement from within the party had rendered them an opportunity to "kill two big birds with one stone".

The delegates must be wary of the unseen hands "manipulating the events leading to the ultimate destruction of the party's image and dignity".

He also warned that there will be further manoeuvres by the third force to provoke the emotions and sentiments of the delegates in the coming days preceding the EGM.

"We are at a crossroads whereby the rationality, sensibility and the maturity of all the delegates have been taken to task," he said.

"Once again, I call upon and appeal to all the MCA delegates to maintain their cool and exercise prudence and due diligence in exercising their vote on the coming EGM. We must emerge stronger and not end up in tatters. It is time to unite for the larger and longer interest of the party's struggles and its unfinished agenda."

Pro-Chua EGM action committee chief coordinator Datuk Seri Tan Chai Ho said the re-emergence of the sex DVD was expected but he disagreed that it was the work of a third force.

"The circulation of the DVD did not just happen once. We have told the delegates that this is going to come. The talk of an involvement of a third force is just a diversion."

Tan said the distribution of the DVD will be ineffective against Chua.

PETALING JAYA: The sex DVD which led to the downfall of Datuk Seri Dr Chua Soi Lek has resurfaced, sparking off a fresh round of controversy and raising the who-and-why question.

MCA central committee member Datuk Ti Lian Ker is blaming it on a “third force” from within the party which re-distributed the DVD to add more fuel to the current leadership tussle.

The DVD, which became public last year, was a recording of a tryst between the suspended MCA deputy president and an unidentified woman.

Dr Chua reportedly said that the DVD was sent from Bukit Mertajam this time. However, the Bukit Mertajam MCA division has denied that they had a hand in it.

Yesterday, Ti said the re-emergence of the DVD was another move by unseen hands to embarrass Dr Chua besides inciting anger and hatred against party president Datuk Seri Ong Tee Keat.

“There is indeed a third force from within the party intending to exploit and inflict maximum damage to the personality and credibility of both Ong and Dr Chua, with little or no love for the party.

“Their motive is obvious – to dislocate and uproot Ong’s leadership and to damage Dr Chua permanently,” he said on his blog http://tilianker.blogspot.com/.

Such an act was targetted at destroying the party and the next party leader would be a lame duck, he said.

“This third force wanted to control MCA’s leadership for their personal agenda. The disagreement from within the party had rendered them an opportunity to kill two big birds with one stone,” he said.

Ti warned delegates to be wary of these unseen hands which were bent on manipulating events that would affect the party’s image and dignity.

'Third force' behind return of Chua's sex DVD

The re-emergence of Dr Chua Soi Lek's infamous sex DVD is a ploy masterminded by a third force, alleged party central committee member Ti Lian Ker.

According to him, it is a two-pronged strategy - incite anger against and embarrass Chua while pinning the blame on his nemesis and current president Ong Tee Keat.

Ti, who is also the MCA NGO bureau liaison chief, lamented that the DVD incident has already damaged the party's credibility.

The DVD, which has resurfaced for the third time, is being allegedly distributed among MCA central delegates and Barisan Nasional component party leaders.

When the scandal erupted last year, Chua resigned from his government and party posts. He was the former health minister and Labis MP.

"The DVD incident is of the past and Chua had been an unfortunate victim of these unseen hands which rendered him a liability to the party," said Ti in a statement.

He warned members of the Chinese-based party not to be distracted by the re-emergence of the DVD.

Ti said the third force was aiming to inflict 'maximum damage' on the party by stoking the anger of Chua’s supporters towards the president.

He added that it was in the interest of uniting the party that an extraordinary general meeting (EGM) was called to decide on the future leadership and to stabilise the party.

'We need to move forward'

However, he said the 'third force' was undermining this effort by damaging the credibility of both Chua and Ong.

"Their apparent motive is obvious, to dislocate and uproot Ong's leadership and damage Chua permanently.

"The ultimate effect of an angry MCA will result in the party being shattered permanently and whoever who leads the party subsequently will be a lame duck," he added.

Ti also cautioned delegates to be wary of the 'third force' manipulating events leading to the ultimate destruction of the party's image and dignity.

"We are on a course of re-branding and seriously walking our talk towards a revitalised MCA with courage, political will and honour. The DVD is a blemish of the past and ought to be left behind.

"Now we need to move forward and move on with the larger picture instead of being stuck in muddy waters. All we need now is a fresh mandate and added strength to enable the present party leadership to continue with the course we have taken," he said.

Ti also reminded delegates to maintain their cool, exercise prudence and due diligence when casting their votes in the upcoming EGM on Oct 10.

"We must emerge stronger and not end up in tatters... it is time to unite for the larger and longer interest of the party's struggle and its unfinished agenda," he said.

PETALING JAYA: A “third force” from within the MCA is redistributing the controversial sex DVD involving Datuk Seri Dr Chua Soi Lek in a bid to add more fuel to the party leadership tussle, said party central committee member Datuk Ti Lian Ker.

He said the re-emergence of the DVD was another move by “unseen hands” to embarrass the former deputy president as well as to incite emotion, anger and hatred amongst party members against party president Datuk Seri Ong Tee Keat.

“There is indeed a ‘Third Force’ from within the party intending to exploit and inflict maximum damage to the personality and credibility of both Ong and Dr Chua with little or no love for the party.

“Their apparent motive is obvious -- to dislocate and uproot Ong’s leadership of the party and to damage Dr Chua permanently,” he wrote on his blog.

He said the act was designed to shatter the party permanently and ensure that the future party leader is a “lame duck.”

“This third force wants to control MCA’s leadership for their personal motive and agenda,” he said, adding that recent disagreements within the party have given them an opportunity to “kill two big birds with one stone.”

Ti warned delegates to be wary of these unseen hands that manipulated events, adding that the sex DVD was an incident of the past and the party was now faced with a leadership conflict.

“The DVD is a blemish of the past and ought to be left behind,” he said.

He said the party needed to move forward.

“All we need now is a fresh mandate and added strength to enable the present party leadership to continue with the course that we have taken,” he said, adding that the party must emerge stronger and not end up in tatters.

PETALING JAYA: PETALING JAYA: Datuk Seri Dr Chua Soi Lek should have gone to the party’s central committee to overturn an earlier decision by the presidential council to sack him instead of pressing for an extraordinary general meeting, a central committee member said.

Datuk Ti Lian Ker said the party constitution stated a central committee member or party official could not be suspended or expelled without the support of two-thirds of the central committee present and voting at the meeting.

“In the case of Dr Chua, he only needed to garner the support of one-third of the central committee to overturn the decision of the presidential council.

“If he had failed to do that, he then had the added avenue in the general assembly by requesting an extraordinary general meeting to reverse the central committee decision,” he wrote on his blog.

Ti said Dr Chua however chose to “disregard and indignified the central committee” by calling it a rubber stamp.

“If he had garnered support of one-third of the central committee to reverse the presidential council decision, could the issue have been settled earlier and rendered the EGM, which is a waste of funds and energy, unnecessary?” he said.

Ti said that express protection provided by the constition was a condition precedent before any expulsion or suspension could be effected.

“The central committee, upon being convened on Saturday (Sept 19), must obtain the support of two-third of its members present before the presidential council’s decision to expel Dr Chua Soi as the deputy president could be effected.

“Therefore, the central committee cannot be denied of its right to deliberate on any actions taken to expel or suspend any party official or central committee member.

“The central committee is duty bound to deliberate and decide on the recommendation by the disciplinary council and presidential council with or without an appeal in the case of a party official or central committee member.

“This provision is a reminder to the presidential council to act prudently to avoid its decisions being overturned or overruled by the central committee,” he said.

On the EGM, he said the party was on the road to recovery and called upon all central delegates to exercise prudence and due diligence at the EGM on Oct 10 “ to stir MCA towards the right direction.”

Dr Chua’s supporters pressed for an EGM to reinstate him following the Aug 26 presidential council decision to endorse a recommendation by the party’s disciplinary board to expel him from the party over his sex video clip issue.

The central committee on Sept 19 however decided to suspend his membership and party post instead, effectively revising the presidential council’s decision.

The EGM would however still be held on Oct 10.

Embattled MCA president and Transport Minister Datuk Seri Ong Tee Keat takes time off party politics and the Port Klang Free Zone (PKFZ) probe to tell R. Nadeswaran and Terence Fernandez that the two issues are indeed related.

Ong: Well, I see our two investigative journalists are here!

theSun: This is the longest story we have been pursuing … six years.
Ong: Well, at the end of the day, we are interested in the ending. How this is going to culminate.
That is very important.

theSun: That depends on all those concerned in seeing that justice is done.

theSun: There are other abuses not related to the free zone that are being uncovered. Shouldn’t the task force be looking into other abuses not related to PKFZ?

You must understand that the task force is focusing on only the 20 over issues regarding the free zone. I am not quite sure if the other abuses are included in its investigations.

Because you have uncovered so many issues on the conduct of the general manager (Datin Paduka O.C. Phang) with regards to PKFZ, doesn’t it warrant an internal inquiry at least on the other affairs of PKA (Port Klang Authority)? The task force reports state that she refused to heed the advice of other officials. She could have taken such an attitude to other matters.

I get what you mean but we need to stay focused. I understand your concerns that certain dimensions of the investigation may be overlooked or neglected or some of these jokers may go scot-free. But the crux of the matter is that we have come so far and we want to see justice done. This is the last lap and the last lap is normally the most challenging part.

Do you support the suggestion that the previous board of directors must be held responsible and be prosecuted for failing in their responsibilities?

They have their jurisdiction of responsibilities but I am not certain of the extent in which they were involved in. Were they properly informed of each and every decision? If not, what remedial solutions did they attempt to take? I have no know-ledge of this, but accountability must be there.
I agree. Whether they should be charged, I cannot answer that as I don’t know to what extent is their involvement.

What about the past chairmen? At the end of the day they are guardians of PKA and should be held accountable for allowing this to go so far.

So far, how much have they (the past chairmen) been informed? Look at (Datuk Yap) Pian Hon for instance. He had 1,001 reasons to protest, 1,001 grouses to air. In all fairness, he was brushed aside probably because she thought that he did not have the intellectual capacity to grasp the issues.

That’s why we need people who know what’s going on. (Present chairman) Datuk Lee Hwa Beng is an accountant by training, so he will know when the numbers don’t add up. Members of the (internal audit) directors include a forklift driver with minimal education. What does he know about port operations? They just come to collect their allowance. Enough of all these political appointees!

We hope this episode will have a positive ending but what is even more challenging is the subsequent part. We must get people who at least know something about the subject matter. You might be a political appointee, but at least be well-versed with the subject matter.

How do we reconcile what you intend to do for the restructuring of PKA and the political realties?

We need to set new rules and that is going to be very unpopular but after all, I have been unpopular.

How we handle PKFZ must be the yardstick for future probes. So it is important to see this to the very end.

You mean use the PKFZ investigations as a template for future probes involving misuse of public funds? Yes! I explained in no uncertain terms to my grassroots behind closed doors why I must take the risk and what gains do I get. Nothing! In fact CSL (sacked MCA deputy president Datuk Seri Dr Chua Soi Lek) said I want to play hero. What hero? As an ethnic Chinese minister, as MCA president can I go further to a higher rank?

But I said that PKFZ should be made a turning point if we really want to bring in a new breed of political culture – of accountability and transparency. We don’t just talk, we must walk the talk and this is a classic example, a real acid test to our commitment to accountability and transparency.

You have the unenviable task of exposing two past MCA leaders, your predecessors in the ministry (Tun Dr Ling Liong Sik and Tan Sri Chan Kong Choy). It must have been really hard for you.

My conscience is clear. When I made the decision to commission PricewaterhouseCoopers (PwC) for the job, I told them that this must be an entirely independent probe. At the end of the day, the PwC Panel informed me of the outcome. Throughout the process I never, ever tried to influence them in one way or another. Even the contents of the findings, I only came to know about it when the report was ready and whether it was going to implicate this or that personality.

Whether from MCA or not from MCA, this never crossed my mind. That’s why I say my conscience is clear because after all, I commissioned the comprehensive audit not as a witch hunt or that I might be harbouring some personal agenda. What personal agenda? I hold firm to what I believe in but of course I had to pay a price for it ... the smears, threats, below the belt blows. Like today (Sept 7) in the Chinese papers, CSL mentioned that by brewing up PKFZ, it will blow up MCA and Barisan Nasional.

They say so many things about me. The latest is that I have gone cuckoo. There have been SMS going around using my number saying I scold people and call them names. I don’t know how it’s done but they are using my name.

So in the challenge to your presidency, PKFZ is the central issue and there are external forces involved in trying to topple you?

When I first decided to commission PwC for the comprehensive audit last October, hardly 10 days into my presidency, I did not correlate PKFZ with my political career in MCA. It was seemingly unrelated. But little did I expect this to have sparked off the kind of collaboration between CSL … the CSL factor and KDSB (turnkey contractor Kuala Dimensi Sdn Bhd) ... (KDSB CEO Datuk Seri) Tiong (King Sing); as I had mentioned in July, as well as some of Ling’s lawyers. This is something that I had never imagined.

Maybe you have broken the unwritten rule that you don’t ‘kacau’ your predecessors.

I don’t know because in politics there are a lot of unwritten rules. When I do certain things, what comes to mind is whether this will serve the public interest. I prioritise the public interest. That’s why I say my conscience is clear. I can tell you very candidly that when certain detractors of mine say I want to play hero, I have everything to lose if this issue is mishandled. It is a ticking time bomb and how do I defuse it? If I do it wrongly, I’ll be blown up.

You could have taken the easy way out by stalling until it becomes someone else’s problem. But you decided to take the bull by its horns.

That’s right. I came in after this entire project was contractually concluded. Immediately after Hwa Beng lodged the police report based on the findings of the task force, that point of time we were talking about RM500 million to RM1 billion in fraudulent claims. Immediately after that, Tiong brought up the story that I took RM10 million from him. In the first place, at the point of time, if a person is to offer any political bribery, he would have expected something in return. But at that material time, what could I have given him as the project was completed and whatever governmental clearance was secured?

Despite the various challenges we had to navigate through we have yet to call it quits. Even after the completion of the report we had taken painstaking efforts to declassify the documents. It took us awhile – four months. And those who couldn’t understand us hurled allegations but we couldn’t tell them. I don’t believe in behaving like a cry baby but this is what we had to go through.

You had instructed for copies of the PwC report to be placed on the tables of all MPs in Parliament. That was not done. Why?

MPs know the rules. Any submission of any literature from the various agencies must be done through the Parliament Secretariat. Meaning we can’t distribute as and when we like. We approached the secretariat but later on I was made to understand that the speaker made the ruling that he is only prepared to release the report in totality with the PAC (Public Accounts Committee) report. For whatever reasons, I wouldn’t know.

I made an appointment to see him at the height of the controversy and I was told that the PAC hearing is still in progress. Of course I understand (DAP stalwart Lim) Kit Siang and his boys made very serious allegations against me, distorting facts which were grossly unfair, but I managed to debunk his biased allegations.

Think about it, why must I suppress it? After all, on May 28 when we decided to release the report after getting the cabinet’s approval, we made it available to the public the next morning. So what’s there for us to hide? But you must understand where the release of documents is concerned; we must abide by the rules.

But to dramatise it by saying I hid the copies in an underground strong room; that was mere drama and fabricated lies. That was absurd!

Throughout the course of your handling of the PKFZ issue, did you make errors in judgment in terms of misplacing your trust in certain individuals that you had handpicked?

It is not absolutely true to say that I handpicked anybody. Certain appointments I have the right to make recommendations but again, whatever recommendations I make have to be scrutinised by higher authorities.

We must admit the very fact that in life, individuals with certain aptitudes may be recommended for certain jobs because of their strengths and aptitude; but one thing for sure we cannot stop any individual from being influenced by various temptations. Even our own kids I don’t think we can do much to contain them or insulate them from being influenced by temptation. Over the years I have seen many such examples but more so in endeavours, especially mammoth projects where the stakes get higher and higher. Somehow or rather people’s pattern of behaviour to a large extent are influenced or moulded by so many variables, including the temptations of money.

So you are a lot more cautious in allowing people into your inner circle?

People can claim what they like but the thing is that I know what I am doing. I need people to be truthful. As a friend you can come to my house but that doesn’t mean I am giving you a carte blanch to do what you like or use my name. There is an unwritten rule of how you treat a friend.

We are going to tread very carefully here because there are two law suits pending but the allegations against you could stem from people who claim to represent you or from your inner circle.

I have come across all sorts of fabricated lies, self-proclaimed inner circles, self-proclaimed confidants. They know that my life and family life is very simple. They know that I don’t need to have so many levels of inner circles and confidants, like an empire. If you talk about inner circle, then what about my aides? Are they in my inner circle?

What are these road shows you have embarked on about?

I have to do it behind closed doors simply because I for one don’t believe in washing dirty linen in public. Also these are untrue stories and members may be influenced by the various lies. So I think it is good to share with them the real scenario they are in now and the real challenges. For me this is part of information sharing and political education. Not just to tell them my side of the story. To me I believe in imparting to them the facts, just like PKFZ. Until today, there are certain quarters harping on their school of thought that this is just an MOT affair, a government affair and even an Ong Tee Keat affair, nothing to do with the party. I must say that is absolutely bull and which is why I need to do the road show.

Since you have set this going, is this a new culture you are setting for the party?

That is what I want to do. That is exactly what I want to do! To me this is not just a battle in the face of the EGM. It is not just that. I want them to understand that I mean business and I tried so hard to bring in a new political culture.

Would you accept the challenge of an open debate with CSL?

I think even before this, there was an invitation for an open debate with CJM (former vice-president Datuk Seri Dr Chua Jui Meng). I must tell you that I for one know that if I were to follow my own wish I can take on anybody. But I must also take into consideration that what is said in the open, might be used as ammunition against the party. And that explains why I declined the offer for an open debate last year from CJM. People were surprised as to why I declined as my character is that I always take on such challenges. I don’t want to wash dirty linen in public and I have been consistent in my statements and principles.

Slams mob antics by aggressive minority as political blackmail against political will of silent majority.

MCA NGO Liaison Bureau would like to congratulate the police and the Attorney General's decision to charge the Shah Alam demonstrators under Section 4(1) of the Sedition Act and Penal Code for sedition and Section 27(5) of the Police Act 1967 for illegal demonstration. Their act of carrying a decapitated cow’s head to the Selangor state Secretariat besides making racial/religious provocative statements are blatant disregards of our law and order.
Of late we have seen Malaysians developing a tendency to resort to mob antics and violence to express themselves. The street demonstrations and mob behaviours are alien to our Malaysian political culture until recent years and they are in direct contrast with the civil society that we are cultivating and expecting.

Taking to the streets over issues like teaching Maths and Science in English etc is a form of political blackmail by an aggressive minority against the political will and desire of the silent majority.

The recent ugly incident of some 50 over demonstrators in Shah Alam against the proposed relocation of the Sri Maha Mariaman Hindu temple with a cow head as well as hurling abuses and inciting racial/religious sentiment goes against the grain of our culture of racial/religious sensitivity and tolerance since independence.

This ugly manifestation of dissent has gone against the Malaysian political culture of consensus building in a legal and peaceful manner.

We hope that the decision to charge these illegal demonstrators and those who had spewed and inflamed religious racial sentiments will be consistent and without regard of their political support or affiliations in order that the Rule of Law prevails.

Malaysians are getting uglier by day and the public must be satisfied that there is no selective persecution in discharging duties to uphold and enforce the rule of law. Justice must be done and be seen to be done.

The tendency to display violence, force, might or brutish behavioral patterns must be immediately nipped at the bud.

MCA further calls upon the Police and the Attorney General to charge the residents who had committed criminal assault and battery against the Menteri Besar of Selangor Tan Sri Abdul Khalid Ibrahim and Shah Alam Member of Parliament Khalid Samad in a recent dialogue with the residents. Both the Menteri Besar and Member of Parliament are honorably elected representatives of the people. The uncouth mob behaviour displayed by several residents such as carrying a chair in a display of violence to an elected official or any member of the public must not be allowed or encouraged. This trend of violence in whatever name must be stopped and there should be no justification given. An offence is still an offence. A wrong is still a wrong.

The people must be taught that the arms of the laws will ultimately catch up with them. They must be made to realize that it does not pay to break the law and we are all equals before the law irrespective of whether you are PKR,PAS,DAP or UMNO/BN.

Positive response from MCA on A-G’s decision to charge cow-head protestors

The decision by the Attorney-General to charge the cow-head protestors has received some positive responses from around, and the MCA is one who lauded the move. According to Lee Wei Kiat, a spokesman of the party, “The decision by the A-G’s Chambers was a positive move towards restoring civility in an otherwise simmering situation in Section 23.

It indicates the A-G’s Chambers, as a public body, is impartial ... when the laws of the land are broken. It was incumbent that the A-G’s Chambers and police implement the rule of law irrespective of the protestors’ political afflication. Public confidence in enforcement agencies is undermined and the perception of selective prosecution emerged if no further action was taken against one group whose actions were tantamount to inciting racial disharmony. While protestors can have ideals they hold on to, at no time whatsoever should public assemblies or closed-door dialogues be allowed to be turned into launchpads of war cries which threaten public order and lives or instigate carnage. Matters are more easily resolved amicably when people of divergent views sit down and talk rationally to work towards a common solution that is acceptable to both parties,”

Datuk Ti Lian Ker, the chairman of the MCA’s Non-government Organisation Liaison Bureau too voiced a similar stand saying that “The Aug 28 incident went against the Malaysian political culture of consensus building in a legal and peaceful manner. We hope that the decision to charge these illegal demonstrators and those who had inflamed religious and racial sentiments will be consistent and without regard of their political support or affiliations so that the rule of law prevails. The police and the A-G should also charge residents who “committed criminal assault and battery” against Selangor Mentri Besar Tan Sri Khalid Ibrahim and Shah Alam MP Khalid Samad in last Saturday’s dialogue. Both are elected representatives of the people. Displaying cow head & threatening bloodshed is seditious in nature

Press statement by MCA NGO Liaison Bureau chairman & Central Committee member Datuk Ti Lian Ker on the placing of a cow’s head at the Selangor state secretariat building

It is with the deepest regret that I write to condemn all forms of extremism. The recent act of displaying a cow head and holding the Government to ransom is an act of treason and seditious in nature.

I call upon all political parties to dissociate themselves from such a barbaric act and to condemn this despicable act in the spirit of our coming Independence Day celebration.

This act of provocation is an insensitivity of the highest order and absolutely abhorable. No responsible citizen should support or justify such acts which tantamount to a war cry in a peaceful and peace loving country like ours.

Has our civil society deteriorated to an extent that we must provoke the sacred beliefs of our brethrens? We must be mindful that all forms of extremism begets extremism! Malaysia is a multi-racial society practising tolerance and moderation. All religions preach tolerance and respect for each other.

Religious freedom is enshrined in our Federal Constitution. We have laws and order governing our religious practices. Nobody should challenge or undermine the due process of the law. There are no laws or regulations by racial or religious sentiments or by numbers based on racial composition of an area.

The barbaric mob act of displaying the head of a cow and threatening bloodshed is a felony and the authorities must act immediately to uphold the spirit of rule of law and to stop further trespass in total disregard or disrespect of the law.

SEMINAR “THE ROLE OF NGOS IN PROMOTING DIALOGUE ACROSS VALUES & CULTURE

"Street demonstrations are everywhere". Conflicts, clashes between tradition and modernity as well as between moderation and extremism, the voices of reasn and harmony seenm to be marginalised. Negative stereotypes and politics of fear and suspicion tend to deepen divides, making friendship difficult to sustain across ethnic lines. Having said these, NGOs have the potential to address some of these issues especially in the context of dialogue towards greater understanding of different cultures and values.

The 2-day event was officially opened by YB Senator Tuan Murugiah A/L Thopasamy, Deputy Minister of the PM's Department. He shared his personal encounter of ethnic divides in most recent events taken place. Malaysians are encouraged to instil '1-Malaysia' especially among the younger generation.

Objective of the seminar:-
1) To educate & promote dialogue as a means to manage issues and conflicts;
2) To bring together NGOs and organisations to share experiences and work on dialogue across cultures;
3) To build a network of NGOs for more effective dialogue across cultures and values;
4) To link with international initiatives to promote dialogue as a culture of peace.

KUALA LUMPUR: The Human Rights Commission (Suhakam) is proposing to the Attorney-General's Chambers to focus on enhancing the expertise of the police on several matters related to the trafficking of humans.

Suhakam commissioner Datuk Dr Raj Abdul Karim said two weaknesses in the police identified by the commission were in identifying victims and in the repatriation of victims.

Raj said these had to be improved urgently to eradicate cases of human trafficking in the country as well as ensuring that victims were not treated as offenders.

"We need to look back to the Anti-Human Trafficking Act in Malaysia because there are some loop holes and there are some areas that we need to strengthen," Raj said.

She added that it is important to have a good screening and identification system in order to differentiate, during a raid on certain entertainment outlets, whether those detained should be considered as victim of human trafficking or were voluntary.

Raj said this to reporters at a news conference at the National Human Rights Institute (NHRI)'s Asean Protocol Development Workshop on the Trafficking of Women and Children here today.

Raj stressed that training to enhance related skills need not be limited to police personnel but should also involve other enforcement agencies like Customs, Immigration, maritime agencies and also Rela.

"Members of enforcement agencies need to know the way to treat a victim, never to treat them as offenders. They should be more careful in asking questions and managing victims.

"Such training is very important. They must not be angry, if you are angry and fierce no one will give answers and cooperation or useful information. As such the police need to be properly trained and provide good protection," she said.

Raj said Suhakam also wanted the Anti-Human Trafficking Act 2007 to be tidied up to ensure the process of repatriation was orderly.

"This is because the sending back process is not proper as there is no physical and mental preparation," she clarified.

"Besides that the existing act only allows a victim holding centre to be managed by the government but we want non-governmental organisations to also run them," Raj added.

Right now Malaysia has only three holding centre, two in Kuala Lumpur and one in Sabah.

The Anti-Human Trafficking Act 2007 is presently being reviewed by the AG's Chambers to make some changes to it.

Asked about the conclusion of the two-day workshop, Raj said representatives of the NHRIs from Malaysia, Indonesia, the Philippines and Thailand unanimously voiced their desire to step up efforts to handle the issue of trafficking in women and children collectively by disseminating information to the public. — Bernama

Support effort to tell full PKFZ story

TRANSPORT Minister Datuk Seri Ong Tee Kiat seems to be besieged by all kinds of problems simply because he refuses to succumb to the “tidak apa” attitude so often adopted with relative ease by others when challenged. Furthermore, he wants to live up to his reputation as a straight talker, a reformer and a fighter.

He could have just laid back and savoured his election to MCA’s presidency and his appointment to a top cabinet post. Of course what he does in his party is of little concern to most Malaysians but how he leads a ministry with such a huge budget and so much on its plate is of much concern to all the people of this country especially when it is saddled with a multi-billion ringgit scandal of the Port Klang Free Zone (PKFZ) – probably proving to be the most expensive debacle ever.

He could have relegated it to the bottom of his priorities as the scandal happened during his predecessors’ watch but he decided that the rakyat must know about the billions that were spent and the billions more that may have to be spent to rehabilitate the zone. To him the government and the ministry he leads owed them that. And so he sanctioned several independent investigations, one of them by PricewaterhouseCoopers, into the badly managed project. The results highlighted the poor level of oversight and governance and numerous conflicts of interest in PKFZ’s development. That was the beginning of the problems for him.

There were moments when it seemed he would be overwhelmed by them. The onslaughts against him have not stopped and may look like they are meant to distract him from his ministry’s current priority of getting to the bottom of the scandal. It is for a cause like this that everyone from those in the cabinet to the poor taxpayers must rally behind the man who is leading the charge.

In the past Malaysians had been shocked by a number of public scandals. But after some days or even weeks of front-page treatment by major newspapers they subsequently were relegated to the inside pages and eventually just faded away. They resurface occasionally in reports on preliminary findings of a task force or special committee. But by that time Malaysians had already lost interest in whatever had happened even though it was their money that was involved. Even though the culprits were exposed – the public had known about them long before the findings were announced – reactions were mostly muted.

But the PKFZ scandal just refuses to die or fade away. Malaysians should, therefore, support the efforts to keep it that way until they know the full story of the PKFZ.

Rule by law, not sentiments

PETALING JAYA: PAS cannot extend the provisions of the Syariah Enactment and impose it on non-Muslims, said MCA non-governmental organisation liaison bureau chairman and central committee member Datuk Ti Lian Ker.

“We are ruled by law and not sentiments based on race or religion,” he said, adding that PAS was effectively extending Syariah laws on non-Muslims under the pretext of Muslim sentiments.

He referred to recent calls by Selangor PAS exco member Datuk Dr Hassan Ali that a blanket ban be imposed on the sale of beer by convenience stores in Muslim-majority areas.

Ti also referred to Dr Hassan’s argument that non-Muslims could easily buy their beer from the many shops outside Muslim-majority areas as arrogant and non-tolerant of the rights of non-Muslims as provided for by law.

He added that Dr Hassan’s argument discarded the existence of DAP as a political partner.

“The Syariah Enactment is enforceable only on Muslims. Non-Muslims have their civil and criminal laws and it is clearly provided that non-Muslims can buy and sell beer without any restrictions or licences,” he said in a press statement yesterday.

He added that as PAS could not respect an express provision of the law, “how can we ever trust PAS to rule the nation and be fair to the non-Muslims? How can DAP falsely assure the community into voting for PAS?”

“The rule of the majority must be with due respect to the minority. The continuous insistence by PAS that the minority give in and sacrifice our rights and liberties in the name of respect to the majority is tantamount to bullying,” he said.

He added that PAS cannot rule the country based on the sentiments or emotions of a few aggressive intolerant leaders who are out to be heroes in their communities.

“What if this Muslim neighbourhood decides to chase out non-Muslims from the neighbourhood one day? What about the right, liberties and sentiments and feelings of non-Muslims?”

Ti said Selangor exco member Ronnie Liu should advise his Pakatan partners (PAS leaders) to concentrate on their dakwah activities and not impose additional restrictions or prohibitions on others.

PETALING JAYA (Aug 6, 2009): MCA today hit out at PAS’s outcry and use of "Muslim sentiments" on the "brewing beer conflict" in the Pakatan Rakyat-ruled Selangor and for infringing on the rights of non-Muslims.

Its central committee member and non-governmental organisation liaison bureau chairman Datuk Ti Lian Ker said in a statement yesterday Selangor PAS’s proposed guidelines regulating beer sales be made in tandem with the Syariah Enactment (Selangor) 1995 is "flawed and bad in law".

In calling for a blanket ban on beer sales in Muslim-majority areas, he said: "PAS is effectively extending syariah laws onto non-Muslims on the pretext of Muslim sentiments.

"We are ruled by law and not sentiments based on race or religion. PAS cannot in effect extend the provisions of the Muslim enactment and impose it on non-Muslims," said Ti.

Referring to the civil law for non-Muslims, he said it clearly allows non-Muslims to buy and sell beer in cans and bottles without any restrictions or licence.

"If PAS cannot respect an express provision of the law, how can we ever trust PAS to rule the nation and be fair to non-Muslims? How can DAP falsely assure the community into voting for PAS?" asked Ti.

He said enforcement officers cannot act based on the sentiments of a Muslim-dominated neighbourhood.

He also slammed Selangor executive councillor Datuk Dr Hasan Ali for his statement on Tuesday asking non-Muslims to travel outside Muslim majority areas to buy beer and blamed Barisan Nasional for failure of such implementation.

"PAS, as usual, is one up against Umno when it comes to showing their arrogance and non-tolerance in absolute disrespect of the rights of non-Muslims rights as provided by the law," said Ti.

He said Hasan’s arguments that non-Muslims have to drive further away to buy beer "is retarded and discards the existence of DAP as a political partner".

"(Selangor executive councillor) Ronnie Liu should advise Pakatan Rakyat (PR) partners, PAS leaders, to concentrate on the dakwah activities and not impose prohibitions and penalties on non-Muslims," he said.

On Tuesday, Hasan had urged Selangor Mentri Besar Tan Sri Khalid Ibrahim to impose the beer ban in Muslim-majority areas in Selangor and called for Liu’s portfolio be reviewed after accusing him of "interfering" in local council enforcements on the sale of beer .

The controversy had resulted in a gag order by Khalid on all the state excos until today when he will announce a solution for the problem.

DAP adviser Lim Kit Siang, when contacted, said he would issue a statement later on the matter.

Therefore, Ti said , the local authorities cannot override the federal laws by confiscating beers sold in bottles or cans in any retail outlets on flimsy or racial grounds.

“We cannot allow our laws or implementation thereof to be coloured by race whereby there are different set of laws based on the geography or demography of the local residents. Malaysia is a plural country and the legislations must be uniform.

Do not infringe upon federal laws

“The federal laws have taken into considerations the diverse culture and the plurality of the nation. No local government can disregard or infringe upon the federal laws that expressly outline the rights and liberties of our plural society,” said Ti.

He added that the sundry and retail shops in Malay kampungs have been selling can and bottle beer for ages as a matter of right and as provided by federal laws. There should be no discrimination on 7-Eleven or any other shops selling can and bottle drinks legally.

There is no legal provision that says that 24-hour outlets cannot sell can or bottle beer. There is no law that prohibits any such sales in a Malay majority area.

Ti said that since there are personal laws that forbid Muslims from purchasing these drinks, therefore enforcement should be against the Muslim wrongdoers and not on the retailers.

The act of confiscation of beers in cans and bottles by the Shah Alam City Council is an ultra vires act and ought not to be condoned by the Local Government Chairman, YB Ronnie Liu or DAP. There must be consistency of the implementation of the laws and the Local Authority cannot overrule an express provision of the law at their personal whims and fancies.

Under Federal Laws, the Excise Act allows beer in bottles and cans to be sold freely and no license is required. Only beers sold in barrels or being served are regulated by the Local Authorities. The Local Authorities cannot override the Federal Laws by confiscating beers sold in bottles or cans in any retail outlets on flimsy or racial grounds.

We cannot allow our laws or implementation thereof to be coloured by race whereby there are different set of laws based on the geography or demography of the local residents. Malaysia is a plural country and the legislations must be uniform. The Federal laws have taken into considerations the diverse culture and the plurality of the nation. No local government can disregard or infringe into the federal laws that expressly outline the rights and liberties of our plural society. It is an irony that Pakatan Rakyat government is advocating the removal of race-based political parties but implementing and colouring the federal laws with race and religion. This is an unhealthy trend, uncalled for and must be stopped.

The sundry and retail shops in Malay kampungs have been selling can and bottle beers for ages as a matter of right and as provided by Federal Laws. There should be no discrimination on Seven-Eleven or any other shops selling can and bottle drinks legally.

There is no legal provision that says that 24-hour outlets cannot sell can or bottle beer. There is no law that prohibits any such sales in a Malay majority area. However there are personal laws that forbid Muslims from purchasing these drinks. Thus enforcement should be against the Muslim wrongdoers and not on the retailers.

Is DAP or YB Lim Kit Siang going to compromise the legal rights and liberties of retail outlets to sell can and bottle beer? If PAS and PKR can just disregard the written provisions of our FEDERAL LAWS as per their whims and fancies, it means that our DAP lawmakers had sold out our legal rights and liberties once again.

DAP is not only following PAS and PKR walks but dancing to their tunes as well!!

Are the DAP talks coming to nought....?

PAS has deprived and disallowed Non-Muslims in Kelantan and Terengganu their rights during their rule. Yet they boastfully claimed and lied that beer and alcoholic drinks were allowed to be sold freely and openly under their rule.

The truth is that these outlets were treated like illegals and deemed to be unlicensed whereas they are actually at liberty to sell can and bottle beer without license. There is an unwritten price or political arm-twisting by authorities on these outlets who were legally entitled but deprived of their rights and liberties.

Imagine being treated as if you are committing a wrong when you are actually protected by the law? Where is the respect for the law? Are we being ruled Taliban styled? Is DAP or Lim Kit Siang going to uphold the law?

Is DAP going to stage a street demonstration to protest this blatant disregard and disrespect of the law by PKR and PAS?

In law we say the people have a right to sell beer in cans and bottles de jure but the peole were deprived of this right de facto....that is to say that in law, the people has the right to sell beer but in fact they were deprived of that right under PAS rule. There is always the blackmail and bribery element at play when traders are coerced to trade tainted with illegality! DAP and Lim Kit Siang must stop their double standards and selective criticism by holding steadfast onto the expressed provisions of the law instead of kowtow-ing to PAS and PKR once again.

Bar Council condemns mass arrest at rally

PETALING JAYA: The Bar Council on Monday condemned the mass arrest and alleged use of force at Saturday’s rally and called on the Government to adhere to the people’s wishes.

The Government must respect the fundamental rights of individuals to assemble peaceably to express their opinions, said council chairman Ragunath Kesavan.

The Malaysian Bar also denounced the government’s “overzealous and abusive show of power” during Saturday’s rally against the Internal Security Act, he said.

It also slammed the “reckless” use of tear gas and water cannons during the rally and urged for the immediate and unconditional release of those who were still being detained, he said.

“The Malaysian Bar is disappointed that the Government has not seen fit to embrace the public’s increased expression of viewpoints as a positive development in our society and accord it the necessary democratic space to flourish.

“Instead, it appears that it is determined to continue stifling public opinion, persecuting and punishing those who speak out while blaming them for creating unrest and disorder.

“Equally deplorable is the treatment of those arrested. Juveniles who were detained were placed in a cell with adult detainees, which is in violation of child rights and procedures for handling juvenile detainees,” he said in a statement Monday.

Ragunath said the Government must exercise restraint and demonstrate its commitment to democratic processes by not pursuing charges against any participant.

“We also urge the Government to immediately heed the calls for reform and to respect the rule of law and fundamental rights.”

Malaysian official accused of selling Myanmar man

KUALA LUMPUR: A Malaysian immigration official was charged with selling an illegal immigrant from Myanmar to human traffickers at the country’s border with Thailand, his lawyer said Monday.

Rahman Selamat, a senior immigration official from southern Johor state, pleaded innocent to human trafficking charges, his lawyer Wan Mohamad Fadzil Maamor said.

If found guilty, Rahman faces up to 15 years in prison. The court in northern Kelantan state refused bail for Rahman pending trial on Aug 25, Wan Mohamad Fadzil said. Further details were not immediately available.

Rahman was arrested July 17 with four other immigration officials and four bus drivers, who allegedly helped transport the migrants to the border.

Police said investigations showed the immigration officers sold an unspecified number of Myanmar migrants detained for living in Malaysia without valid travel documents to human traffickers at the Thai border for up to RM600 each.

The traffickers then allegedly took the migrants into Thailand and told them to pay RM2,000 each for their freedom, or they would be forced to work in the fishing industry, police said.

It was unclear if the other Malaysian officials or bus drivers accused of involvement would also be charged. The officials did not specify the ethnicity of the migrants, but most Myanmar people who try to enter Malaysia are ethnic Rohingya Muslims.

In April, a report by the US Senate Committee on Foreign Relations said illegal Myanmar migrants deported from Malaysia were forced to work in brothels, restaurants and on fishing boats in Thailand if they had no money to buy their freedom.

The United Nations refugee agency has registered more than 48,000 refugees in Malaysia, most from Myanmar. But community leaders estimate the number of Myanmar people in Malaysia is about twice that.

rally OUR support behind MCA President !

I called upon leaders and members of MCA and the public to rally their support behind MCA President Dato Seri Ong Tee Keat who had been criminally threatened by "secret society brothers" and politico-business forces who had a direct interest in the PKFZ issue.

I am shocked to note that a Minister had been criminally threatened with death and with personal injuries in the course of discharging his duties.MCA had under the short spell of Dato Seri Ong Tee Keat's leadership attempted to walk a path of honesty, integrity and dignity by adopting an objective, professional and practical approach in order to rebrand and upgrade her image.

Despite the fact that PKFZ involved a huge sum of money and powerful personalities, MCA had been steadfast in it's stand that the truth behind PKFZ must be revealed and offending parties must be brought to justice in due course. Any attempts to thwart the disclosure and investigation of the wrongdoings or abuses involving PKFZ must be strongly opposed and discouraged.

Malaysians irrespective of their political leanings must put aside their feelings and lobby behind the Minister of Transport and the Government to continue with the effort of bringing the culprits to justices. It is time to send a clear signal and message that no man is above the law of the land and all wrongs will be duely prosecuted irrespective of race,creed or breed.

The Minister in reopening the PKFZ file that had been deemed 'closed' earlier must be applauded. The Minister by insisting on an independent audit company to investigate and re-examine the case is acting according to the people's expectation of transparency and accountability. The courageous steps and meticulous procedures taken by the Ministry is exemplary of a new order and a new culture in line with the aspirations of the people.

MCA is also proud that their President had spearheaded the walk of transparency and accountability in order that individuals who had committed any wrongs or criminal acts must be held personally responsible instead of the party.

The people must also come to the defence of righteous Ministers or leaders who dare to take the bull by the horns in the spirit of the "People First" instead of joining in the chorus of those who had attacked the initiatives taken with a hidden agenda of their own. All efforts taken in the interest of public delivery and transparency must be unequivocably supported without fail in order that Malaysians benefitted in the long run.

Religion 'SPY'

MCA NGO Liaison Bureau supported the call by Rev. Ng Moon Hing, Executive committee chairman of Christian Federation of Malaysia that the act of spying on worshippers of another religion and participating in their Holy Communion is indecent and in breach of spirit of the Federal Constitution's guarantee on freedom of religion.

The act of spying and reporting made by two Al-Islam journalists is an offensive act contrary to the Malaysian culture of peace, harmony and tolerance. MCA called upon the Minister of Home Affairs to act against individuals, institutions or publications that had acted in a manner that is deemed provocative or sensitive to another religion as this will provoke anger and promote enmity amongst a multi-religious society like Malaysia.

It is regrettable that religious bodies or institutions had to resort to 'spying'. It is very unbecoming of any religion to spy on another as all religion preaches the spirit of faith and fear in God. Religion preached good over evil. Act of spying, cheating etc are acts contrary to the fundamentals of any religion and may undermine or threaten the inter-religious harmonious practices and traditions in Malaysia.

Malaysians and the spirit of 1Malaysia promote goodwill and togetherness. The authorities must stop all acts in bad faith (mala fide) and nip the problem in the bud before we started a spy war that may escalate into a bigger problem.

MCA wants action against Al-Islam journalists

PETALING JAYA: The spying and reporting by the two Al-Islam journalists were offensive and contrary to the Malaysian culture of peace, harmony and tolerance, the MCA NGO Liaison Bureau said Saturday.

Its chairman Datuk Ti Lian Ker called on the Home Minister to act against individuals, institutions or publications that acted in a manner deemed “provocative or sensitive to another religion.”

He said this when supporting the statement by Executive committee chairman of Christian Federation of Malaysia Rev Ng Moon Ling that it was a breach of the spirit of the guarantee of freedom of religion in the Constitution when the journalists spied on Christians and participated in their Holy Communion.

is PAKATAN walking their talk ?

I am surprised to read that a certain Selangor Exco Member from Pakatan Rakyat had allowed his/her State Exco office to be used as a regular meeting place by businessmen known to be connected with underground activities.In the name of accountability and transparency as advocated by Pakatan, I called upon YB Azmin Ali and YB Wee Choo Keong to provide the details and identity of the Exco concerned in order these blatantly unhealthy practices and support by a Senior Pakatan Government Exco Member be taken to task and stopped immediately.

This is the first known case of an Exco Member openly and unabashly supporting ''underground business activities'' by allowing his/her office as a meeting place after more than 50 years of independence. It is very shocking that this happened in the Pakatan Government within a year of assuming power as the Selangor Pakatan Government.

I further supported Wee's call that YB Teresa Kok from DAP whom had been swift and loud to scandalized any perceived wrongdoing of BN leaders, is calling for actions against the whistle blower Azmin Ali instead of calling for immediate actions or investigations on the allegation coming from a Senior Pakatan component party leader.

Theresa Kok should be consistent with DAP's regular demand for a high standard of transparency and accountability by calling for actions and discipline against the perpetrator or wrondoer instead of attempting to cover up the matter and disallowing freedom of expression by a fellow elected representative in the State Assembly forum. This is indeed shocking and against the spirit of democracy and a civil society.

DAP's Teresa Kok's outburst and intolerance of component parties criticism smack of arrogance prevalent to PAKATAN leaders particularly in PAS and DAP.

It is very obvious that PAS and DAP had set a very high moral for others in particular Barisan Nasional leaders but they have a different set of morals and values for PAKATAN leaders. This double standard and insincerity of not walking their talk practiced by PAKATAN is very dangerous and contrary to demand and mood of the people now.

Police report on Muslim men spying in Catholic churches

We are deeply concerned that two Muslim men acting on false information that the Catholic Church was converting Muslims into Christians had recently entered a Catholic Church service for the purpose of gathering information as to whether this was occurring.

They were also investigating whether the word ‘Allah’ was being used in church services. These men participated in the church service and even took part in the rituals that are strictly for Catholics and in doing so violated the sanctity of what Catholics hold very sacred.
These men later wrote about their experience in an article entitled “Tinjaun Al Islam Dalam Gereja:Mencari Kesahihan Remaja Murtad” which was published in the May 2009 issue or the Al Islam magazine.

The men had consumed the ‘communion’ which is a white wafer which is blessed by the Priest in a Catholic ritual that dates back 2000 years. Via this ritual the ‘white wafer’ is supernaturally transformed into what Catholics believe to be Jesus Christ and when consumed allows Catholics to experience life after death. The ‘communion’ is held with great reverence and cannot in any way be mishandled or with a lack of respect. Even Catholics are not allowed to take home the ‘communion’ but are instructed to consume it immediately during the service. Catholics go through an elaborate process of preparing themselves to receive this ‘communion’ worthily and those who have not done so are advised to refrain from receiving it.

As such we are outraged that these Muslim men consumed it only to spit it out later, have it photographed and have its image published in the Al-Islam magazine. The total disrespect shown to what Catholics hold in closest to their hearts and believe to be most Holy strikes deep into our hearts and invokes much anger. While we are resolved not to allow anger to guide our actions and instead pray that these ignorant will be forgiven by the Allah, we want to know what has become of this most holy ‘communion’ and demand its immediate return to the church authorities.

We are further outraged that these Muslim men have violated our sense of privacy to freely worship. Would these men tolerate non-Muslims entering the mosque and violating the sanctity and holiness of their worship? We believe that all places of worship and the form of worship practiced in these places must be respected with the greatest sensitivity and reverence be they the church, mosque, temple or gurdwaras. Entering these premises with the intention to spy and worse to violate the sanctity of the worship only serves to incite anger and hatred that could lead to potentially dangerous consequences that would tear this country apart.

As such, as concerned Catholics, we have made a police report at the Patani Road Police station on 8th July 2009 and thereafter held a press conference at the same place. We requested that the police investigate this matter with great urgency and bring to books those responsible for acting to incite hate and resentment among the Catholic Community. We also call on the police to investigate both the Al-Islam magazine and the writers of the article.

Lims blamed for misleading people into backing PAS

KUALA LUMPUR: The DAP’s Lim Kit Siang and Lim Guan Eng should be held responsible for misleading the people into supporting PAS based on a fallacy, MCA non-governmental organisation liaison bureau chairman Datuk Ti Lian Ker said.

He said the father-and-son team had done this so that Guan Eng could continue to be the Penang Chief Minister.

As for Kit Siang, he said backing PAS would enable him to realise his dream of becoming a Federal Minister through an alliance with the Islamist party which, however, has a different political pursuit.

Ti said this in a statement yesterday in reaction to the Kedah DAP announcing that it was leaving the PAS-led Pakatan Rakyat state government.

He said the perception that PAS was abandoning its intention to set up an Islamic state was untrue. Instead, he said the party had never given up its politics of race and religion.
“This was clearly shown in the demolition of the only abattoir and the increase in the bumiputra housing quota to 50% in Kedah,” Ti said.

“DAP must come clean and tell the truth about PAS’ political agenda while acknowledging that their political alliance with the party was untenable."

“They must be honest in telling the people that PAS is a party with thick racial and religious overtones and as such, is unsuitable for a multi-racial country like Malaysia,” he said.

Ti said DAP leaders must respect the voices of the people in the spirit of democracy and not hoodwink their members into an unholy alliance again.

马华中委兼非政府组织局主任 拿督郑联科报章文告

针对巴生自由贸易区稽查报告所引发的舆论交锋,马华中委兼非政府组织局主任拿督郑联科吁请怡保东区国会议员林吉祥即刻停止发布虚实不分、似是而非的言论,以免妨碍当局依法跟进调查。
拿督郑联科在一篇文告中表示,自从该稽查报告公布于世之后,一般人民群众都可以谅解,交通部长拿督斯里翁诗杰已经尝试以最专业和依法的手段,积极完成一切善后工作,不过,这些合法合理的举措,都无法满足林吉祥基于党派政治对立,一再蓄意挑衅和无理攻击交通部长。林吉祥私自以为发布大量的攻击性言论,摆设“一日三问”的言论擂台,可以证明自己是这项议题的权威,然而,民主言论的存在价值,必须是质量并重的。言论繁多,见报率频密并不代表林吉祥是这个议题的权威,毕竟,稽查报告已经公布于世,人民可以作出初步定论之外,其他后续议题,还必须等待当局继续依法查办。
林吉祥的言论数量和性质,已经导致公众日益混淆,甚至忽略了民联阵营内部,先后传出分裂和争吵的声音。因此,林吉祥应该做好自己的本分,尽速解决以下三项课题,以挽回人民群众对民联的信心:-

(1) 槟城州豆蔻村的印裔同胞,以为民联政府可以保障他们的权益,今天却面对集体逼迁的后果。林吉祥及他的儿子林冠英不但没有挺身捍卫,而且刻意推卸责任,使人联想起民联的口号“人民的主权”,变成了空洞的承诺。这个印裔社区的人民根本没有主权,在民联州政府的统治下,他们连自己的家园都被政府掠夺了。

(2) 在回教党州政府一声号令之下,吉打州太子路过港宰猪场被强行摧毁,行动党无法挺身捍卫华裔的权益,一声“退出州政府”,可以补偿华社的损失吗?

(3) 首相兼财政部长于日前宣布,即日起凡在大马股票交易所寻求挂牌的公司,一律不再强制保留30%股权给土著投资者,消息传开之后,市场人士积极欢迎称好,可是,回教党主席哈迪阿旺却坚持反对。身为回教党的盟友,行动党应该向华社交代清楚,两党之间的关系经常陷入混乱对立,如何取信于人民群众?

Press Statement Issued by Dato' Ti Lian Ker, Chairman of MCA NGO Liaison Bureau and MCA Central Committee member calling on DAP YB Lim Kit Siang to halt his unsubstantiated statements on PKFZ

MCA NGO Liaison Bureau: Kit Siang must halt unsubstantiated generalizations on PKFZ. His statements may hinder on going investigationsThe MCA NGO Liaison Bureau calls upon DAP stalwart YB Lim Kit Siang to stop confusing the public with regard to the handling of PKFZ issue, instead of complicating ongoing investigations by relevant authorities with his incessant barracks of irresponsible public statements with no regard for the truth.

The Minister of Transport, Dato Seri Ong Tee Keat has adopted an open and transparent conduct in handling the PKFZ issue. He had practised a high standard of professional and legal approach and in a manner to the satisfaction of the average man in the street. The Minister had also directed that the PKFZ AUDIT REPORT be forwarded to the MACC for further actions in accordance to the law in the event of any wrongdoing. The Minister had further directed that all payments of claims must be made in accordance with professional advice and that the due process of the law must be strictly adhered to at all instance.

As such, Dato Seri Ong Tee Keat ought to be lauded for his competency, accountability and transparency. He had successfully introduced a high professional, creditable and accountable approach in handling a highly complicated and difficult issue of perceived abuse that required thorough professional investigations.MCA NGO Liaison Bureau calls upon Lim Kit Siang to stop exploiting and confusing the public by capitalizing the PKFZ issue based on unsubstantiated generalization or baseless and speculative accusations in a very irresponsible manner. His statements may hinder or obstruct ongoing investigations on the parties and personalities involved in any possible wrongdoing.Pakatan Rakyat must settle problems in their own backyards.

Lim Kit Siang should instead concentrate on putting his house in order and in particular with regard to the following issues:

(1) the demolition of the Kg. Buah Pala settlement, despite undertakings and promises made by PAKATAN leaders and YB Dato’ Seri Anwar Ibrahim during the general election campaign last year. During the campaign, an undertaking was given that this would not happen if PAKATAN were to rule in line with the principle of KETUANAN RAKYAT.

(2) the demolition of the abattoir in Kg. Berjaya in Jalan Putra Alor Setar by PAS state government in a high handed manner without providing an alternative or sufficient time and with no regard to appeals by the people. Again where is the KETUANAN RAKYAT? What we are seeing now is KETUANAN PAS with no rooms for compromise or respect for the rights of others.

(3) PAS President Ustaz Hadi's about turn on the abolition of the 30 PER CENT quota as announced by YAB Dato Seri Najib. This was despite repeated assurances, promises and undertakings by PAKATAN that the racial quota will be abolished under their rule. Instead the Kedah PAS government had increased the housing quota to 50% and Hadi is opposing decisions made by the BN government to this effect.

It would appear that Kit Siang was trying to divert the PAKATAN's differences and internal problems with PAS etc by focusing on PKFZ issue that had been properly handled by the Minister professionally in full transparency, accountability and in accordance with the due process of the law to the general satisfaction of the public.Kit Siang should answer to the people his numerous lies and false undertakings to the people instead of picking on an issue that have been handled well by the Transport Minister and is awaiting its due course of action. Kit Siang is responsible for allegedly misleading the people about PAS real policies and intent. Instead of harping on PKFZ like an old accordion, he must instead confront PAS and inform the public the ugly truth about PAS.
